These General Terms and Conditions of Sale (hereinafter the “GTC”) apply to any purchase made by an Internet user - natural person (hereinafter the “customer”) on the website www.doucea.co, (hereinafter referred to as the “site”).

Preamble
Any order placed on the site necessarily implies the unreserved acceptance of these General Terms and Conditions by the customer.
The T&Cs published on the site are the latest in force, they apply on the date of the order by the customer.
They may, at any time and without notice, be modified by Doucéa, in particular to take into account any legal, jurisprudential and/or technical developments.
The customer is informed and acknowledges that this site is intended for individual consumers.
Professional buyers should contact the sales department to obtain suitable general conditions of sale.
Purchase of Products
To be able to purchase a product, the customer must create an account, providing information allowing them to be identified by completing the form available on the site.
The information that the customer provides on the site when placing an order must be complete, accurate and up-to-date.
Products are offered while stocks last.
If the product is unavailable after the order has been placed, the customer will be informed by email.
The photographs on the site are used to illustrate the products sold and are not contractually binding.
Price
All prices presented on the site are expressed in euros, all taxes included, in particular French value added tax (VAT) at the rate in effect on the order date.
Shipping charges may apply and are detailed when ordering.
Prices are subject to change without notice. The prices applied to the customer correspond to those displayed on the website at the time of the order.
Orders
Online orders are made on this site, using the following process:
- The customer identifies himself or creates his account by providing all the requested elements
- The availability of the selected products is checked automatically
- The customer proceeds to payment under the conditions provided
- The order is confirmed by email
- The order is processed upon receipt of payment.
Confirmation of the order implies acceptance of the General Terms and Conditions, acknowledgement of having full knowledge of them and waiver of the right to invoke other conditions of purchase. All data provided as well as the recorded confirmation will constitute proof of the transaction.
In the event of possible unavailability of one or more products after placing the order, the customer will be notified by email.
The customer will have the choice of being reimbursed the amount corresponding to the unavailable products, or of being delivered when the products concerned are back in stock (unless the product(s) are permanently removed from the catalog).
Payments
Online payments are made through a secure system so that no third party can access the data transmitted on this occasion.
All payment information provided on the site is transmitted to the payment management provider and is not processed on the site.
All necessary measures are taken to guarantee the security and confidentiality of data transmitted online as part of payment on the site.
The customer who pays for his order by credit card on the site guarantees that he has the necessary authorizations to use the card payment method when placing the order. The products ordered remain the property of Doucéa, until final and full payment of their price, in accordance with the terms of Law No. 80 335 of May 12, 1980.
In the event that, for whatever reason, opposition, refusal or other, the transmission of the flow of money owed by the customer proves impossible, the order is cancelled.
Withdrawal
Pursuant to Articles L.221-5 et seq. of the Consumer Code, the customer has a period of fourteen (14) days after the day on which the customer, or a third party other than the carrier and designated by the customer, takes physical possession of the product, to return any new and unopened product, in its original packaging and in perfect condition (any product that is damaged, incomplete, damaged or whose packaging is deteriorated will not be taken back), to request a refund without penalty.
The customer is informed that for certain products marketed via the site, the right of withdrawal is excluded, with regard to sealed goods which cannot be returned for reasons of health protection or hygiene and which have been unsealed by the customer after delivery.
Only the customer identified as such on the site can exercise this right, to the exclusion of any other person, and in particular the person receiving the delivery if different.
To exercise his right of withdrawal and in accordance with Article L.221-21 of the Consumer Code, the customer must notify his decision to withdraw, using the following e-mail address: contact@doucea.co . The following information must be indicated clearly and precisely in the message:
- Product reference
- Invoice number
- Purchase order number
- Order date
- Date of receipt
- Payment method used
- Name of the customer, and where applicable, the beneficiary of the order
- Customer address
- Delivery address
In order for the withdrawal period to be respected, the customer must send his communication relating to the exercise of the right of withdrawal before the expiry of the withdrawal period.
Effects of withdrawal
In the event of withdrawal by the customer, Doucéa undertakes to reimburse all sums paid, including delivery costs to the customer (with the exception of additional costs arising, where applicable, from the customer's choice of a delivery method other than the standard delivery method offered by Doucéa) without undue delay and, in any event, no later than fourteen (14) days from the day on which Doucéa receives the returned product, and if it has neither been opened nor used. (Article L.221-24 of the Consumer Code).
Doucéa will make the refund using the same means of payment as the customer used for the initial transaction, unless the customer expressly agrees to a different means; in any event, this refund will not incur any costs for the customer.
Doucéa is not required to reimburse additional costs if the customer has expressly chosen a more expensive delivery method than the standard delivery method offered by Doucéa.
Reimbursement will be made after receipt of the goods.
Return Policy
The customer must, without undue delay and, in any event, no later than fourteen (14) days after communicating his decision to withdraw from this contract, return the unused goods to:

This deadline is respected if the customer returns the product concerned by the return before the expiry of the fourteen (14) day period.
The product must be returned following Doucéa's instructions and must include all accessories delivered.
The return of the product is at the customer's expense.
The return of the product is made at the customer's risk. If the package is lost, stolen, or damaged during the return process, Doucéa reserves the right to refuse a refund for the returned product(s).
Delivery
Delivery tracking can, where applicable, be performed using some carriers' online tracking tools. Customers can also contact Doucéa's sales department by email at contact@doucea.co to obtain information on the status of their order.
Deliveries are made to the address indicated in the order. Packages are shipped according to the delivery costs stated at the time of ordering and according to the delivery times corresponding to their geographical area.
In all cases:
It is strongly recommended to collect it from the collection point indicated by the carrier within 24 working hours with the delivery notice and proof of identity. If the package is not collected within the aforementioned time limit, Doucéa cannot be held responsible for any possible damage to the products.
If the recipient does not respond within the specified timeframe or if the package is reshipped to Doucéa, delivery will be considered complete and no refund of the product to another address will be made. If the home address corresponds to a public establishment (hospital, etc.) or a private establishment (company, clinic, retirement home, etc.) and the package cannot be delivered in person to the recipient, delivery will be considered complete from the moment the package has been handed over to the reception or department of the establishment dedicated to receiving goods.
The delivery time indicated when the order is placed is given for information purposes only and is not guaranteed in any way. Consequently, any reasonable delay in the delivery of the products may not give rise to the buyer's liability for:
- the allocation of damages;
- cancellation of the order.
Upon receipt of the product, the customer must check in the presence of the carrier the condition of the packaging and the delivered product, as well as the conformity of the delivery to the order. If the product(s) have been damaged or the delivery does not correspond to the order, the customer must inform the carrier and Doucéa within three days by email at contact@doucea.co to agree either to return the order or to the allocation of a credit corresponding to the total amount of the order.
The customer is responsible for the information they provide, including the delivery address. Doucéa is not responsible for delivery errors caused by an incorrect address.
The customer is responsible for all risks once the order leaves Doucéa's premises. Any protest regarding damage occurring during transport must be made by way of a reasoned claim to the carrier within three days of delivery. A copy of this claim will be sent to Doucéa. No claims or reservations will be accepted after the customer receives the products.
Delivery costs and options are chosen when ordering and are validated by the customer when confirming the order.
They appear on a specific line, separate from the one specifying the price of the products.
The amount of delivery costs varies depending on the territory of delivery of the products.
Delivery times are provided for informational purposes only and depend on the carrier and delivery method chosen by the customer. Delivery times exclude Saturdays, Sundays, and public holidays.
Miscellaneous provisions
In the event of a dispute relating to an order, the customer must first contact Doucéa, in order to find an amicable solution, by email at contact@doucea.co .
The mediator may only be contacted after the customer has taken prior written steps with Doucéa.
Any dispute or litigation referred to as consumer dispute may be subject to amicable settlement by mediation with the CMAP – Centre de Médiation et d’Arbitrage de Paris (in application of articles L612-1 et seq. of the Consumer Code).
These General Terms and Conditions are governed by French law, unless otherwise provided.
In the absence of an amicable solution and whatever the origin of the conflict, disputes relating to the execution or interpretation of these General Terms and Conditions will be submitted to the competent courts of Paris, unless otherwise required.
